Thank you for visiting https://flmoonshine.com or the mobile application on which these Terms and Conditions reside (collectively, the “Site”), which is owned and provided by Florida Moonshine, LLC. Your use and access to the Site are governed by and subject to the following Terms and Conditions. If you do not agree to these terms or our Privacy Policy, please do not use the Site or any services offered by the Site.
Your Registration Obligations
You may be required to register with the Site or provide information about yourself (e.g., name, date of birth, email address, and credit card) to access and use certain features of the Site. If you choose to register, you agree to:
- Provide and maintain true, accurate, current, and complete information about yourself as prompted by the Site’s registration form.
- Abide by our Privacy Policy governing registration data and other information about you.
Note: Individuals under 21 years of age are not authorized to use the Site.
Member Account, Password, and Security
You are responsible for maintaining the confidentiality of your password and account details, if any, and are fully responsible for all activities that occur under your password or account. You agree to:
- Immediately notify the Site of any unauthorized use of your password or account or any other security breach.
- Ensure that you exit from your account at the end of each session when accessing the Site.
Florida Moonshine, LLC will not be liable for any loss or damage arising from your failure to comply with these obligations.
Orders
Florida law limits the sale of our spirits to face-to-face transactions at our distillery. Orders placed on our Site are not fulfilled by Florida Moonshine, LLC but are instead passed to a licensed retailer (“the Retailer”) authorized to accept and ship orders to approved states. The online store is managed by a third-party company, and aside from product descriptions shown on our Site, is hosted by them.
By placing an order (“Order”) through the Site, you agree to:
- Provide your payment information when submitting a request for products.
- Use purchased products for personal use only or as gifts for individuals aged 21+.
- Not resell or distribute purchased products for commercial purposes.
All orders are subject to acceptance by the Retailer, and you may receive written confirmation via email or your account on the Site that the order has been transmitted.
Shipping
- Availability: Shipping is not available to all states.
- Delivery Time: Expect a minimum of two (2) weeks and up to six (6) weeks for delivery.
- Adult Signature Required: An adult (21+) signature is required at the time of delivery. Orders will not be left by the carrier.
- Issues with Orders: Any shipping or delivery issues must be resolved by the Retailer. Current retailer details are listed in each product’s description.
Taxes
Prices exclude various jurisdictional taxes (federal, provincial, state, and local). Such taxes will be added to the invoice as a separate charge wherever applicable.
Issues with Orders
Florida Moonshine Company strives to offer excellence in our products and services. If you are dissatisfied with your purchase, please contact us:
- For spirits: Email orders@flmoonshine.com to connect with the Retailer for a refund or credit status.
- For merchandise or wearables: Email shop@flmoonshine.com to request a return label for shipping unworn items back to us for a full refund.
Third-Party Services and Websites
The Site may provide links or access to services, sites, technology, and resources provided by third parties (“Third-Party Services”). Additionally, you may enable or log in to the Site via Third-Party Services like Facebook, Instagram, Google, or Threads.
- Your Responsibilities: Access and use of Third-Party Services may be subject to additional terms, conditions, and privacy policies. You may also need to authenticate or create separate accounts to use such services.
- Information Sharing: Some Third-Party Services may provide us with access to certain information you have shared with them. We will use, store, and disclose such information per our Privacy Policy.
- Disclaimer: Florida Moonshine Company is not responsible for Third-Party Services, their accuracy, availability, reliability, completeness, or privacy practices. Any dealings with third parties while using the Site are solely between you and the third party.
